Prices

All prices indicated in the online shop already include the 21 per cent value added tax provided for by the laws of the Republic of Lithuania.

Order fulfilment

Order fulfilment takes 1-2 working weeks.

Delivery of goods

Goods are delivered by courier service to the house at the address indicated at the time of ordering; if an additional carry-in service was ordered, the goods will be delivered to the door.

Warranty obligations

The main characteristics of each item sold are indicated in general terms in the product description provided with each item. Certain goods are covered by a manufacturer’s warranty, the terms and periods of which are specified in the descriptions of such goods and detailed in the warranty card.

Returns

Goods are returned and exchanged on the basis of Article 6.218 of the Civil Code of the Republic of Lithuania, “Article 7, Part 3, Point 4 of the Law on Consumer Rights Protection of the Republic of Lithuania, and Points 16-22 of the Rules on the Return and Exchange of Goods approved by Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001”.

Regarding the return of goods (due to unsuitable quality or other reasons provided for in Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 “Rules on the Return and Exchange of Goods”), notify by e-mail at info@pagalves.lt. Goods of poor quality or returned for reasons permitted by legislation are accepted at the address Kalvarijų g. 143, Vilnius.

Before purchasing a mattress or other goods, you must familiarise yourself with the Purchase Terms and Conditions, which are provided below. You confirm that you have familiarised yourself with the terms and conditions of the purchase contract by completing the goods Order form and clicking the “Buy” link.

Purchase – sale contract

1. General provisions

1.1. These rules for the purchase and sale of goods (hereinafter the “Rules”), once the Buyer has agreed to them (having familiarised themselves with the Rules and completed the order form on the website pagalves.lt; the Buyer confirms that they have familiarised themselves with these Rules by completing the goods order form on the website pagalves.lt and clicking the “Buy” button), constitute a legal document binding on the parties, setting out the rights and obligations of the Buyer and the Seller, the conditions for acquiring goods and paying for them, the procedure for the delivery and return of goods, the liability of the parties, and other provisions related to the purchase and sale of goods in the “pagalves.lt” online shop.

1.2. The Seller reserves the right to amend, correct or supplement the Rules at any time, taking into account the requirements established by legislation. The Buyer will be informed of any amendments, corrections or supplements via the e-mail indicated upon log-in and, in order to purchase goods in this online shop, will have to agree once again to the amended Rules.

1.3. The following have the right to buy in our online shop:

1.3.1. competent natural persons, i.e. persons who have reached the age of majority and whose capacity is not restricted by court order;

1.3.2. minors aged between fourteen and eighteen years, only with the consent of their parents or guardians, except in cases where they independently dispose of their own income;

1.3.3. legal persons;

1.3.4. authorised representatives of all the persons indicated above.

2. Protection of personal data

2.1. Any information related to personal data and provided by the Buyer when entering data in the “pagalves.lt” online shop is subject to the Seller’s personal data protection policy, the terms of which are detailed in the “Your Privacy” section on the website.

3. Moment of conclusion of the purchase – sale contract

3.1. The contract between the Buyer and the Seller is deemed concluded from the moment when the Buyer, having selected the item(s) to be purchased and formed a shopping basket, clicks the “Buy” link.

3.2. Every purchase – sale contract concluded between the Buyer and the Seller is registered and stored in the database of the “pagalves.lt” online shop.

4. Rights of the Buyer

4.1. The Buyer has the right to buy goods in the “pagalves.lt” online shop in accordance with the procedure established by these Rules and the online shop.

4.2. The Buyer has the right to withdraw from the purchase – sale contract concluded with the “pagalves.lt” online shop by notifying the Seller in writing (by e-mail, indicating the item to be returned and its order number) no later than within 7 (seven) working days from the day of delivery of the item.

4.3. The Buyer’s right provided for in point 4.2 of the Rules is implemented in accordance with the “Rules on the Sale of Goods and Provision of Services where contracts are concluded using means of communication”, approved by Order No. 258 of the Minister of Economy of 17 August 2001.

4.4. The Buyer may exercise the right provided for in point 4.2 of the Rules only if the item has not been damaged or its appearance has not changed substantially, and it has not been used.

5. Obligations of the Buyer

5.1. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.

5.2. The Buyer, using the “pagalves.lt” online shop, undertakes to comply with these Rules and other conditions clearly indicated in the online shop, and not to violate the legislation of the Republic of Lithuania.

6. Rights of the Seller

6.1. If the Buyer attempts to harm the stability and security of the online shop’s operation or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend their ability to use the online shop.

6.3. In the event of significant circumstances, the Seller may temporarily or entirely cease its online trading activity, having notified the Buyer in advance, within 5 (five) working days.

6.4. The Seller has the right, without prior notice to the Buyer, to cancel their order if the Buyer, having chosen the payment methods provided for in points 8.2.1 or 8.2.2 of the Rules, does not pay for the goods within 5 (five) working days.

7. Obligations of the Seller

7.1. The Seller undertakes, on the conditions established in these Rules and in the online shop, to provide the Buyer with the opportunity to use the services provided by the “pagalves.lt” online shop.

7.2. The Seller undertakes to respect the Buyer’s right to privacy regarding the personal information belonging to them indicated in the online shop order form, except in cases established by the laws of the Republic of Lithuania.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by them on the conditions specified in point 9 of the Rules.

7.4. Where, due to significant circumstances, the Seller is unable to deliver the goods ordered by the Buyer, the Seller undertakes to offer an analogous item or an item as similar as possible in its characteristics. Should the Buyer refuse to accept the analogous item or the item most similar in its characteristics, the Seller undertakes to return the money paid to the Buyer within 15 (fifteen) working days, if advance payment was made.

8. Prices of goods, payment procedure and terms

8.1. The prices of goods in the online shopping centre and in the formed order are indicated in euros, including VAT.

8.2. The Buyer pays for the goods by one of the following methods:

8.2.1. Payment using electronic banking – this is advance payment using the electronic banking system used by the Buyer. In order to use this form of payment, the Buyer must have signed an electronic banking agreement with one of the banks indicated below: AB bankas Swedbank; AB DNB Nord bankas; AB SEB Vilniaus bankas; AB Parex bankas; AB Ūkio bankas; AB Šiaulių bankas; AB Danske bankas; AB Nordea bankas and Paysera LT. When paying for goods by this method, after the Buyer completes the electronic goods order form, the Seller, within 1 working day, sends an advance online shop invoice for prepayment to the indicated e-mail address. On the basis of this invoice, the Buyer pays for the goods and informs the Seller of the completed money transfer (if it was not paid via the Paysera LT bank). Responsibility for data security in this case lies with the respective bank, since all monetary operations take place in the bank’s electronic banking system.

8.2.2. Payment by bank transfer – this is advance payment, when the Buyer, having printed out the advance online shop invoice for prepayment and gone to the nearest bank branch, transfers the money to the bank account of MB “Čiužinių centras” (Mattress Centre).

8.3. When paying by the payment methods provided for in points 8.2.1 and 8.2.2, the Buyer undertakes to pay immediately. In the said cases, taking into account the Seller’s right provided for in point 6.4 of the Rules, only upon receipt of payment for the goods does the formation of the goods parcel begin and the goods delivery term begins to be counted.

8.4. The advance online shop invoice for prepayment indicates the selected goods, their quantity, the final price of the goods including all taxes, and the delivery charges.

9. Delivery of goods

9.1. The Buyer, when ordering goods, undertakes to indicate the place of delivery of the goods.

9.2. The Buyer undertakes to accept the goods themselves. In the event that they cannot accept the goods themselves, but the goods have been delivered to the indicated address and on the basis of the other data provided by the Buyer, the Buyer has no right to raise claims against the Seller regarding delivery of the goods to an inappropriate party.

9.3. The goods are delivered by the Seller or their authorised representative.

9.4. The Seller undertakes to deliver the goods to the Buyer in compliance with the terms indicated in the goods descriptions. These terms do not apply in cases where the required goods are not in the Seller’s warehouse and the Buyer is informed of the shortage of the goods they ordered. At the same time, the Buyer agrees that, in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such a case, the Seller undertakes to contact the Buyer immediately and agree on the goods delivery matters.

9.5. In all cases, the Seller is released from liability for breach of the goods delivery terms if the goods are not delivered to the Buyer or are delivered late through the Buyer’s fault or due to circumstances depending on the Buyer.

9.6. At the time of delivery of the goods, the Buyer must, together with the Seller or their authorised representative, check the condition of the consignment. Once the Buyer has signed the invoice (waybill) or another consignment transfer – acceptance document, the consignment is deemed to have been handed over in proper condition. Having noticed that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this in the invoice (waybill) or another consignment transfer – acceptance document and, in the presence of the Seller or their representative, draw up a free-form act of damage to the consignment. If the Buyer fails to perform these actions, the Seller is released from liability towards the Buyer for damage to the goods, if such damage was caused by packaging damage which the Buyer did not note in the manner established above.

10. Quality guarantee of goods and shelf life

10.1. The characteristics of each item sold by “pagalves.lt” are indicated in general terms in the product description provided with each item.

10.2. The Seller is not responsible for the fact that the goods in the online shop may, in their colour, shape or other parameters, fail to correspond to the actual size, shapes and colour of the goods due to the characteristics of the display used by the Buyer.

10.3. The Seller provides a quality guarantee for goods, valid for a certain time, for certain types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods.

10.4. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided for in the relevant legislation of the Republic of Lithuania applies.

11. Return and exchange of goods

11.1. Defects of sold goods are remedied, and goods of poor quality are exchanged and returned, in accordance with the Rules on the Return and Exchange of Goods approved by Order No. 217 of the Minister of Economy of 29 June 2001 “On the approval of the Rules on the Return and Exchange of Goods”.

11.2. In order to return the item(s) in the cases indicated in point 11.1 of the Rules, the Buyer must complete a goods return document in free form and submit it together with the item(s) being returned.

11.3. The Buyer may exercise the right provided for in point 11.1 of the Rules within 7 (seven) working days from the day the goods were delivered to them, by notifying the Seller in the manner provided for in point 4.2 of the Rules.

11.4. When the Buyer returns goods, the following conditions must be observed:

11.4.1. the item being returned must be in its original or undamaged packaging;

11.4.2. the item must not have been damaged by the Buyer;

11.4.3. the item must not have lost its merchantable appearance (labels not damaged, protective films not torn off, etc.) (this point does not apply where a poor-quality item is being returned);

11.4.4. the item being returned must be of the same configuration as it was received by the Buyer;

11.5. The Seller has the right not to accept goods returned by the Buyer if the Buyer does not comply with the goods return procedure established in Article 11.

11.6. In the event that an item is returned on the basis of the right provided for in point 4.2, the goods return costs are borne by the Buyer. The goods return charges applied by the Seller are provided in point 9.7 of the Rules. Where a wrong item and/or a poor-quality item is returned, the Seller undertakes to collect such goods and replace them with analogous suitable goods. In the event that the Seller does not have analogous goods, it returns to the Buyer the money paid for the item(s).

11.7. The return and exchange of goods is carried out in accordance with the “Rules on the Return and Exchange of Goods” approved by Order No. 217 of the Minister of Economy of 29 June 2001 and the “Rules on the Sale of Goods and Provision of Services where contracts are concluded using means of communication” approved by Order No. 258 of the Minister of Economy of 17 August 2001.

12. Liability

12.1. The Buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences arising therefrom.

12.2. The Buyer is responsible for the actions performed using this online shop.

12.3. The Buyer is responsible for the transfer of their log-in data to third parties. If the services provided by “pagalves.lt” are used by a third party who has logged in to the online shop using the Buyer’s log-in data, the Seller regards this person as the Buyer.

12.4. The Seller is released from any liability in cases where losses arise due to the fact that the Buyer, disregarding the Seller’s recommendations and their own obligations, did not familiarise themselves with these Rules, although such an opportunity was provided to them.

12.5. If there are links in the Seller’s online shop to the websites of other companies, institutions, organisations or persons, the Seller is not responsible for the information found there or the activities carried out, does not supervise or control those websites, and does not represent those companies or persons.

12.6. In the event of damage, the party at fault compensates the other party for direct losses.

13. Marketing measures applied by the Seller

13.1. The Seller may, at its own discretion, initiate various promotions in the “pagalves.lt” online shop.

13.2. The Seller has the right to unilaterally, without separate warning, change the conditions of promotions, as well as to cancel them.

14. Exchange of information

14.1. The Seller sends all notices to the e-mail address provided by the Buyer in the registration form.

14.2. The Buyer sends all notices and questions using the means of communication indicated in the “About us / contacts” section of the Seller’s online shop.

15. Final provisions

15.1. These rules are drawn up in accordance with the legislation of the Republic of Lithuania.

15.2. The law of the Republic of Lithuania applies to relations arising on the basis of these rules.

15.3. All disagreements arising over the performance of these rules are resolved by negotiation. If agreement cannot be reached, disputes are resolved in the manner established by the laws of the Republic of Lithuania.
